SpotSplit™ Terms of Service

These Terms of Service ("Terms") govern your access to and use of the SpotSplit™ website, mobile app, and platform (the "Platform"), owned and operated by a South Carolina limited liability company doing business as SpotSplit™ ("SpotSplit," "we," "us," or "our").

By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, do not access or use the Platform.

1. Overview of the Platform

SpotSplit™ connects individuals or businesses that want to rent access to private land, ponds, docks, or gear (collectively, “Hosts”) with individuals looking for access to outdoor experiences such as hunting, fishing, trapping, kayaking, camping, and related activities (collectively, “Guests”). SpotSplit™ acts solely as a marketplace and does not own, control, or manage any property or gear listed on the Platform.

2. Eligibility

To use SpotSplit™, you must be at least 18 years old and able to enter into legally binding contracts. By using the Platform, you represent that you meet these requirements.

3. Account Registration

You must create an account to list or book properties or gear. You agree to provide accurate information and to keep your account credentials confidential. You are responsible for all activity under your account.

4. Fees and Payments

  • SpotSplit™ is free to join and free to browse.
  • Guests pay a fee set by the Host plus a service fee retained by SpotSplit™.
  • SpotSplit™ charges a small percentage from each successful booking transaction.
  • All payments are processed through third-party payment processors. SpotSplit™ does not store credit card data.

5. User Responsibilities

Guests agree to:

  • Follow all laws, property rules, and safety guidelines.
  • Use land and gear responsibly and ethically.
  • Assume all risks associated with outdoor activities.

Hosts agree to:

  • List only properties or gear they have full legal right to rent.
  • Clearly communicate access rules, boundaries, and conditions.
  • Maintain safe, lawful conditions for use.

6. Limitation of Liability

SpotSplit™ is not liable for:

  • Injuries, property damage, or death occurring during use of any listing.
  • Misrepresentation or conduct of any user.
  • Weather, wildlife, or acts of nature.

All users acknowledge the inherent risks involved in outdoor activities and agree to hold SpotSplit™ harmless.

7. Disclaimers

SpotSplit™ makes no warranties, express or implied, regarding listings, including their availability, legality, safety, or suitability.

We are not a party to any agreement between Host and Guest.

8. Cancellations & Refunds

Each Host sets their own cancellation policy. Guests should review this before booking. SpotSplit™ may assist with dispute resolution but does not guarantee refunds.

9. Prohibited Conduct

Users may not:

  • Violate any laws or property rights.
  • Post fraudulent, unsafe, or misleading listings.
  • Engage in harassment or abuse.

We reserve the right to suspend or terminate accounts at our sole discretion.

10. Intellectual Property

All content on the Platform — including logos, text, graphics, and software — is owned by SpotSplit™ or licensed to us and may not be copied or used without permission.

11. Dispute Resolution

South Carolina law governs these Terms. Any legal action must be brought in the state or federal courts of South Carolina.

We encourage users to resolve disputes informally, and may offer mediation support.

12. Indemnification

You agree to defend, indemnify, and hold SpotSplit™, its owners, affiliates, and staff harmless from any claims, losses, or expenses arising from your use of the Platform or violation of these Terms.

13. Changes to These Terms

We may update these Terms at any time. If we make material changes, we’ll notify users via the Platform or email. Continued use after notice constitutes acceptance.
